A Lasting Power of Attorney is a document by which you nominate a person or people who can help you make decisions when you are not able to do so, either because you are physically frail or you are no longer able to make a decision for yourself. A Property and Financial Affairs LPA may be used as soon as it has been registered with the Office of the Public Guardian (OPG). A Health and Welfare LPA can be used after registration with the OPG, but only after you have lost capacity to make your own decision.

 

Either type of LPA can be used by the nominated person or people to reflect your wishes and in your best interests.

We will be happy to discuss requirements with you and guide you through the procedure of preparation and registration of the LPA, including consideration of the safeguards required to protect your position.

 

If you lose the ability to make your own decisions and it becomes necessary for someone (even a close relative) to act on your behalf and you have not made an LPA, it may then be necessary to apply to the Court of Protection for appointment of a deputy to make those decisions. This is a more involved and expensive procedure and may not reflect your own wishes. Because of this, we recommend planning ahead with an LPA.

Guidance and help with Financial Decisions, Health & Welfare

We prepare Lasting Powers of Attorney (LPA’s), both Financial and Health and Welfare. These documents enable individuals of your choice, your attorneys, to make decisions in your best interest when you are unable to do so.

 

Health and Welfare LPAs enable your attorneys to play an instrumental role in your care and to stand in your shoes for the purpose of making important decisions about your health and welfare including life sustaining treatment.

 

Financial LPAs enable your attorneys to manage your financial affairs, again in your best interests and at a time when you are unable to manage your own affairs.  

 

Our Charges:

£350.00 plus VAT for a single LPA

£600.00 plus VAT for two LPA’s

£1,000.00 plus VAT for four LPA’s (ie both types of LPA for a couple)

 

Disbursements:

We have to pay a fee for registration of the LPA at the Office of the Public Guardian – presently this is £82.00 per LPA
